Welcome to Learnaling! These Terms of Service (“terms”) govern your use of our website, membership subscriptions, courses, teaching materials and related services (collectively the “service”). By signing up for or using the service you agree to these terms.
1. About Us

2. Acceptance & Scope
By accessing Learnaling on this platform or using materials from Learnaling, you are agreeing to be bound by these Terms and Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. You are agreeing that Learnaling is not responsible for any conduct on your part towards third parties and are further agreeing to indemnify Learnaling for any harm to third-parties resulting from your conduct. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trademark law.
These terms apply to all users of the Service: visitors, registered users and paying members.
3. Eligibility & Account Registration
You must be at least 18 years old to use this site.
You agree to provide true, accurate and complete information when registering your account and to maintain and promptly update your account details.
You are responsible for maintaining the confidentiality of your account login information and for all activity that occurs under your account.
You must not share your account credentials, transfer your account or let others access it in your name.
4. Membership, Subscriptions & Billing
Access to certain content or features requires a paid membership (“Membership”). The billing period and subscription fees will be as displayed at the time of checkout.
Subscriptions are automatically renewed at the end of each billing period or trial period, unless you cancel in advance.
For payment security, Learnaling uses a third-party payment processor, Stripe, to handle all transactions. Your credit or debit card details are transmitted securely and are not stored or accessible to Learnaling. Stripe acts as an independent data controller for payment information and processes it in accordance with its own terms and privacy policy. You are responsible for reviewing and complying with Stripe’s Terms of Service and Privacy Policy.
With regard to VAT, the supply of the service may be subject to the reverse charge mechanism in the customer’s country. You are responsible for assessing your local VAT obligations.
We may change prices, billing terms or offer different membership tiers; we will provide reasonable notice of any changes affecting your renewal.
5. The Service & Content Licence
All content provided as part of the service is owned by us or our licensors. We grant you a personal, non-exclusive, non-transferable licence to access and use Learnaling’s materials for your own teaching purposes. This is the grant of a license, not a transfer of title, and under this license you may not:
a) modify or copy the materials or any portion of the materials.
b) share the materials, except where expressly permitted to share certain resources with your own students (e.g. homework workbooks).
c) use the materials for any commercial purpose other than your own use in teaching your students during the period of your license, or for any public display (commercial or non-commercial).
d) attempt to decompile or reverse engineer any software contained on this site.
e) remove any copyright or other proprietary notations from the materials.
f) transfer the materials to another person or 'mirror' the materials on any other server.
g) give any other person the ability to access your account.
h) transfer or purport to transfer any rights in the use or ownership of the materials.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Learnaling at any time.
Upon terminating your membership or upon the termination of this license, you must destroy any copied/downloaded materials in your possession whether in electronic or printed format.
6. Acceptable Use & Conduct
You agree to use the Service only for lawful purposes and in compliance with these Terms. We reserve the right to suspend or terminate your access immediately if you breach these Terms.
You must not use the Service to:
infringe any third-party intellectual property rights;
transmit harmful, illegal, offensive or defamatory content;
interfere with or disrupt any systems, networks or users;
share your account with others, or allow others to act under your identity.
Suitability of content
When using the Service for teaching, you are responsible for reviewing and selecting content that is appropriate and suitable for your students’ or learners’ age, ability, background and educational context. We are not responsible for how our resources are used in teaching settings.
User-generated content
If you upload or submit any user-generated content (e.g., comments, resources), you warrant and represent that:
a) you are entitled to post the content on our website and have all necessary licenses and consents to do so;
b) the content does not infringe any intellectual property rights of any third party;
c) the content does not contain any defamatory, libelous, offensive, indecent, or otherwise unlawful material or material that is an invasion of privacy
d) you are granting Learnaling permission to use, reproduce, modify, display and distribute it in connection with the Service, and to authorize others to use, reproduce and edit any of your content in any and all formats.
7. Cancellation, Termination & Suspension
You can cancel your subscription(s) at any time in your account settings; cancellation takes effect at the end of the current billing period or trial period. Unless required by applicable law, any fees already paid will not be refunded on cancellation. Please ensure you cancel in advance of your next payment date if you do not wish to continue your subscription.
We may suspend, restrict or terminate your account or access if you fail to pay fees, breach these Terms, or for any reason at our discretion.
On termination or expiry of your membership, your licence to use our content ends and you must cease all access to and use of the materials and destroy or delete any saved materials.
8. Disclaimer of Warranties & Limitation of Liability
Disclaimer
Learnaling’s materials are provided 'as is'. Learnaling makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Learnaling does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its site or otherwise relating to such materials or on any sites linked to this site.
Limitations
In no event shall Learnaling or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Learnaling’s site. This includes, without limitation, the inability to use materials or services because they were withdrawn from Learnaling or because of any site malfunction. Learnaling reserves the right to withdraw content, applications, or functionality at any time, with or without notice to users. Learnaling makes no guarantees about future provision of services and reserves the right to terminate its services to any or all users at any time.
Revisions & Errors
The materials appearing on our web site could include technical, typographical, or photographic errors. Learnaling does not warrant that any of the materials on its web site are accurate, complete, or current. Learnaling may make changes to the materials contained on its web site at any time without notice. Learnaling does not, however, make any commitment to update the materials.
User-generated content
Certain parts of Learnaling’s site and associated sites offer the opportunity for users to post and exchange opinions, information, material, and data (“user-generated content”). This user-generated content is not to be attributed to Learnaling and reflects the view and opinion of the person who posts such a view or opinion. To the maximum extent permitted by law, Learnaling shall not be responsible or liable for this content or for any loss cost, liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of any content. Learnaling reserves the right to monitor this content and to remove any content for any reason.
9. Links & Third-Party Services
We may provide links to third-party websites or services. We do not endorse, control or assume responsibility for those external sites or their content. Your use of them is at your own risk.
10. Privacy & Data Protection

11. Changes to Terms

12. Governing Law & Dispute Resolution
These Terms are governed by the laws of Scotland and any dispute shall be resolved in the courts of Scotland.
If you are a consumer, nothing in these Terms affects your rights under consumer protection laws.
13. Miscellaneous
Entire Agreement: These Terms (together with any other documents expressly referenced) constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
Severability: If any provision of these Terms is found invalid or unenforceable it will be severed and the remaining provisions will continue in full force.
Waiver: A failure by us to enforce any right under these Terms does not constitute a waiver of that right.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights or obligations, provided we give notice to you.
Notices: Any notice to you may be given via email or posting on our website; notice to us must be to our contact address specified in Section 1.
